DECISION ON THE 2018 ACTIVITY REPORT OF THE AFRICAN
COURT ON HUMAN AND PEOPLES’ RIGHTS

The Executive Council,

1. TAKES NOTE of the Activity Report of the African Court on Human and Peoples’ Rights (the Court) for the period 1 January to 31 December 2018;

2. CONGRATULATES the Republic of Tunisia on the successful hosting of the 51st Ordinary Session, held in Tunis, Tunisia, from 12 November to 7 December 2018;

3. RECOMMENDS the Draft Framework for the implementation of judgments of the Court to the STC on Justice and Legal Affairs, for consideration, prior to its submission to the Executive Council;

4. TAKES NOTE of the Court’s request to suspend the establishment of a Trust Fund for the Court pending the outcome of the All Institutional Reform Process;

5. URGES the Commission to take all necessary measures in conformity with previous Executive Council Decisions to operationalize the Legal Aid Fund in 2019, and to this end, ENCOURAGES all Member States of the Union as well as other relevant human rights stakeholders on the continent, to make generous voluntary contributions to the Fund to ensure its sustainability and success;

6. URGES Member States which are yet to ratify the Protocol on the Establishment of the Court to do so, and CALLS UPON State Parties to deposit the Declaration required under Article 34 (6) allowing individuals and NGOs to bring cases before the Court;

7. REQUESTS the Court to report at the 36th Ordinary Session of the Executive Council in February 2020, on the implementation of this Decision.
