Regulation C/REG.11/11/96 on Modalities for Appointment to Vacant Posts at the Executive Secretariat and the ECOWAS Fund

The Council of Ministers,MINDFUL of Articles 10, 11 and 12 of the Revised Treaty of the Economic Community of West African States (ECOWAS) establishing the Council of Ministers and defining its composition and functions;MINDFUL of the ECOWAS Staff Regulations;MINDFUL of Decision C/DEC. 5/12/94 dated 17th December, 1994 freezing the payment of certain allowances to staff of the Community Institutions;CONSIDERING that long delays in filling vacant posts retard the activities of the Community Institutions and undermine their performance;BEARING IN MIND Decision A/DEC. 5/7/95 of 29th July, 1995 establishing sanctions applicable to Member States in arrears of various contributions of the Community Institutions;AWARE, however, that the continued implementation of Community programmes demands that modalities be established for filling vacant posts at the Executive Secretariat and the ECOWAS Fund;AWARE also of the need to motivate staff members called upon to assume temporarily, the duties and responsibilities of superior officers;ON THE RECOMMENDATION of the nineteenth meeting of the Administration and Finance Commission held in Lome from 11th to 19th November, 1996;ENACTS

Article 1

Posts rendered vacant within the Executive Secretariat and the Fund for reasons other than official mission, shall be filled as follows:
a)a competent staff member shall be appointed to carry out, in an acting capacity, the duties and responsibilities of a superior officer whose post becomes vacant;
b)where the provision of the above paragraph cannot be applied, the Executive Secretariat and the Fund shall employ staff on a contract basis, for a renewable period not exceeding one year.

Article 2

The acting allowance provided for in Article 33 of the Staff Regulations suspended by Decision C/ DEC. 5/12/94, is hereby restored in respect of staff members who are in a higher capacity.

Article 3

This Regulation shall be published by the Executive Secretariat in the Official Journal of the Community within thirty (30) days of its signature by the Chairman of the Council of Ministers.It shall also be published within the same time-frame by each Member State in its National Gazette.
